Gibson Handcraft reserves the right to update these Terms and Conditions from time to time. The version published on this website at the time an order is placed will apply to that order unless otherwise agreed in writing.
2. Product Descriptions
Every item produced by Gibson Handcraft is individually handcrafted using traditional leatherworking techniques and natural materials. As a result, each piece is unique and may vary slightly from photographs, samples, or previous examples.
Natural Materials
Leather is a natural material and may contain characteristics such as:

These characteristics are considered part of the material's natural beauty and are not defects.
Colour Representation
Every effort is made to accurately represent the colour and appearance of products through photographs and descriptions. However, colours may appear differently depending on lighting conditions, photographic settings, and individual screen or device displays.
Minor variations between photographs and the finished product should be expected.
Handmade Construction
Products are individually handmade rather than mass produced. Small variations in stitching, edge finishing, leather appearance, and other handcrafted details may occur between items.
Such variations are inherent to handmade work and are not considered faults or defects.

Where a product is commissioned or made to an agreed specification, any substantial changes will be discussed with the customer prior to manufacture.
Care and Use
Leather is a durable but natural material that requires appropriate care.
Products should be protected from excessive moisture, prolonged direct sunlight, chemical exposure, and misuse. Natural wear, surface marks, softening, and the development of patina over time are normal characteristics of genuine leather and contribute to the character of the product.
Product Suitability
Customers are responsible for determining whether a product is suitable for their intended use. If there is any uncertainty regarding dimensions, capacity, functionality, or suitability, customers are encouraged to contact Gibson Handcraft before placing an order.
Traditional Craftsmanship
Gibson Handcraft strives to balance traditional craftsmanship with durability and practicality. Traditional construction methods, materials, and aesthetic details may differ from those commonly found in mass-produced leather goods and should not be regarded as defects.
3. Bespoke and Made-to-Order Items
Definitions
For the purposes of these Terms and Conditions:
Made-to-Order Items are products manufactured after an order is placed but based on an existing Gibson Handcraft design, with limited options such as leather selection, thread colour, hardware, sizing, or personalisation.
Bespoke Items are products designed or substantially modified to meet a customer's specific requirements and may involve consultation, design development, prototyping, or custom construction.
Artisan Production
Gibson Handcraft is a small independent workshop where all work is undertaken by a single craftsman. Customers engaging Gibson Handcraft for bespoke or made-to-order work acknowledge that the value of a commissioned piece lies not only in the finished item, but also in the time, skill, design development, material selection, and craftsmanship involved in its creation.
As each commission is individually produced, lead times may vary and work is scheduled according to workshop capacity and existing commitments.
Quotations and Estimates
Any quotation provided by Gibson Handcraft is valid for the period stated in the quotation or, if no period is specified, for thirty (30) days from the date of issue.
Quotations are based on the information available at the time and may be revised if project requirements, materials, specifications, or scope change.
Estimated completion dates are provided as a guide only and are not guaranteed.
Deposit and Payment
A deposit equal to fifty percent (50%) of the quoted price is required before materials are ordered and work commences.
The deposit becomes non-refundable once materials have been purchased or work has commenced, as costs have been incurred specifically for the customer's commission.
The remaining balance is payable upon completion and must be received before the item is dispatched or released to the customer.
Where staged payments have been agreed in writing, payment must be made in accordance with the agreed schedule.
Design Consultation and Approval
Customers are responsible for reviewing and approving any specifications, drawings, measurements, material selections, personalisation details, or other information provided during the design process.
Approval by the customer constitutes acceptance of those specifications for manufacture.
Gibson Handcraft is not responsible for errors resulting from incorrect information supplied or approved by the customer.
Changes to an Order
Requests for changes after approval may not always be possible.
Where changes can be accommodated:

Significant design changes may require a revised quotation and may affect the agreed completion date.
Materials and Natural Variation
Leather, hardware, and other natural materials may vary in appearance from samples, photographs, or previous commissions.
Where a specified material becomes unavailable, Gibson Handcraft will consult with the customer regarding suitable alternatives before proceeding.
Completion Timeframes
Every effort will be made to complete work within the estimated timeframe provided.
However, because all work is carried out by hand and may depend on material availability, supplier lead times, workshop workload, and other factors beyond reasonable control, completion dates are estimates only.
Production schedules are provided in good faith and do not constitute a guarantee that work will be completed by a specific date unless expressly agreed in writing.
Delays do not entitle the customer to cancellation, refund, or compensation except where required by law.
Cancellation
Customers may request cancellation of an order before materials have been purchased and work has commenced.
Where materials have been purchased or work has commenced, the fifty percent (50%) deposit is non-refundable.
Where substantial work has been completed beyond the value of the deposit, Gibson Handcraft reserves the right to recover the reasonable value of labour, materials, and expenses incurred up to the date of cancellation.
Personalised Items
Items incorporating initials, names, monograms, inscriptions, or other personalised details are manufactured specifically for the customer.
Customers are responsible for ensuring all personalisation details are correct prior to approval.
Personalised items cannot be returned or exchanged due to errors in information supplied by the customer.
Ownership
Ownership of any bespoke or made-to-order item remains with Gibson Handcraft until full payment has been received.
Completed items will not be dispatched or released until all outstanding amounts have been paid in full.
Unpaid or Uncollected Items
Customers will be notified when a commission, repair, or restoration has been completed and is ready for collection or dispatch.
Items remaining unpaid or uncollected for more than ninety (90) days after notification may incur reasonable storage charges.
Where an item remains unpaid or uncollected for an extended period, Gibson Handcraft reserves the right to take reasonable steps to recover costs, dispose of the item, or sell the item in accordance with applicable law and after providing reasonable notice to the customer.
Photography and Portfolio Use
Gibson Handcraft reserves the right to photograph completed work for portfolio, website, social media, educational, editorial, or promotional purposes.
Where a commission contains sensitive, confidential, or personal information, customers may request in writing that photographs not be published. Such requests will be considered on a case-by-case basis.
Australian Consumer Law
Nothing in this section excludes, restricts, or modifies any rights or remedies available to consumers under the Australian Consumer Law.
4. Pricing, Quotations and Payment
The following terms apply to the pricing of products and services offered by Gibson Handcraft, including ready-made products, made-to-order items, bespoke commissions, repairs, and restoration work.
Currency
All prices displayed on this website are in Australian Dollars (AUD).
Gibson Handcraft is not currently registered for Goods and Services Tax (GST). Accordingly, GST is not charged on products or services and no GST component is included in any quoted or advertised price.
Should Gibson Handcraft become registered for GST in the future, pricing and invoicing practices may be updated accordingly.
Pricing
Every effort is made to ensure that prices, descriptions, and specifications displayed on this website are accurate at the time of publication.
Prices may be changed at any time without notice. However, any price agreed and confirmed as part of an accepted order or quotation will remain valid for that order unless otherwise agreed between Gibson Handcraft and the customer.
Quotations
Written quotations are valid for the period specified in the quotation or, where no period is specified, for thirty (30) days from the date of issue.
Quotations are based on current material costs, labour requirements, and project specifications. Gibson Handcraft reserves the right to revise a quotation if project requirements, material selections, or other specifications change.
Payment for Website Orders
Unless otherwise stated, payment for ready-made products and standard website purchases is required in full at the time an order is placed.
Orders will not be dispatched until payment has been received and cleared.
Payment for Bespoke and Made-to-Order Work
Payment terms for bespoke and made-to-order work are set out in Section 3 of these Terms and Conditions.
Unless otherwise agreed in writing:

Gibson Handcraft accepts payment using the payment methods made available through this website or otherwise agreed with the customer.
Customers are responsible for ensuring that sufficient funds are available and that payment details provided are accurate and current.
Pricing Errors
While every effort is made to ensure pricing accuracy, occasional errors may occur.
If a product, service, or quotation is found to contain an obvious pricing, typographical, or administrative error, Gibson Handcraft reserves the right to correct the error and, where necessary, cancel or decline the affected order prior to dispatch or commencement of work.
Where payment has already been received, the customer will be notified and offered the option of proceeding at the correct price or receiving a full refund.
Late Payment
Gibson Handcraft reserves the right to withhold dispatch, collection, delivery, or release of any goods until all outstanding amounts have been paid in full.
Unpaid items may be subject to the provisions relating to uncollected items set out elsewhere in these Terms and Conditions.
Australian Consumer Law
Nothing in this section excludes, restricts, or modifies any rights or remedies available to consumers under the Australian Consumer Law.
5. Intellectual Property
Unless otherwise stated, all content published on this website, including photographs, product images, text, descriptions, logos, graphics, designs, and other materials, is the intellectual property of Gibson Handcraft and is protected by applicable copyright and intellectual property laws.
Content from this website may not be copied, reproduced, distributed, modified, published, or used for commercial purposes without the prior written permission of Gibson Handcraft.
Customers who purchase a product from Gibson Handcraft acquire ownership of the physical item only. The purchase of a product does not transfer any intellectual property rights relating to the design, photographs, branding, or other associated materials.
Gibson Handcraft reserves the right to photograph and display completed work for portfolio, website, educational, editorial, social media, or promotional purposes unless otherwise agreed in writing.
6. Limitation of Liability
To the fullest extent permitted by law, Gibson Handcraft shall not be liable for any indirect, incidental, consequential, special, or economic loss arising from the use of, or inability to use, any product or service supplied by Gibson Handcraft.
Customers are responsible for determining the suitability of a product for its intended use and for using and maintaining products in an appropriate manner.
Gibson Handcraft is not responsible for damage resulting from misuse, neglect, improper storage, accidents, modifications, unauthorised repairs, normal wear and tear, or failure to follow any care instructions provided.
Where repair or restoration services are performed on customer-owned items, Gibson Handcraft will exercise reasonable care and skill in carrying out the work. However, due to the age, condition, prior repairs, or hidden defects that may exist in vintage or previously used items, Gibson Handcraft cannot guarantee that all damage can be successfully repaired or that additional issues will not become apparent during or after the restoration process.
Where liability cannot be excluded under applicable law, Gibson Handcraft's liability is limited, at its option, to:

Re-performing the service; or

Refunding the amount paid for the product or service.
Nothing in these Terms and Conditions excludes, restricts, or modifies any rights or remedies available to consumers under the Australian Consumer Law.

8. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of Australia and the laws of South Australia.
By using this website or purchasing products or services from Gibson Handcraft, customers agree to submit to the non-exclusive jurisdiction of the courts of South Australia and Australia in relation to any dispute arising from or connected with these Terms and Conditions.
If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable, that provision shall be severed from the remaining provisions, which shall continue in full force and effect.
